MP3 Downloads Site Owner Arrested – Do you Support Music Piracy?

July 11, 2011 by Amit Bhawani 70 Comments

Music PiracyMany webmasters have started hosting and offering illegal download links and also sharing MP3 music songs through their blogs. The site owners take the rules very lightly and feel that this a very easy way to earn money on the Internet.

The Cyber Cell of Mumbai Crime Branch arrested a student in gujarat who was running a blog where readers could directly download pirated music songs while the licensed owners loosing money because of this. Following this when more tracking was done there were multiple websites found by the investigators like www.songsdl.com, www.mp3don.com etc Source : Indian Express

This is nothing new because cases like these have become common these days because its the users who download these pirated content from these websites and in return help these pirated site owners more famous and encourage them. Its time you should stop downloading content from these kind of websites, about which we have had reported earlier too. Ex : Guruji.com offering illegal MP3 Songs while legal sites like Hungama.com never getting the right promotion.

Around 3 years back a guy from North India buzzed me on Google Talk seeking for help on what to do, after getting a legal notice from one of the large Music Production House from India. The case came up when he was offering illegal downloads through his blogs and T-Series sent him a notice along with a huge amount of fees. Check out the article where in T-Series moves to delhi high court against YouTube.

Do you know someone who offers these kind of services, its better to suggest them to stop these kind of websites or else they would get themselves into so big problems that coming out of those would be very hard.

There is no solution for that as of now, because i guess it does not come in the Indian Judiciary and the Government of India nor the Music Licensing Companies can go against them.

Amit, There are many sites which shows disclaimer like this “This is a promotional website only, All the downloadable content provided on this site (All metrials) is for testing/promotion purposes only. All files placed here are for introducing purpose. We highly ENCOURAGE users to BUY the CDs or DVDs of the movie or the music they like. Please, buy original Songs/contents from author or developer site!”. and also promises that if anybody make complaint about any content they will remove it. Is this makes them legal?

No this does not make them legal, but they add this based on advice from other site owners who don’t real know or understand the laws. If you start selling stolen stuff with a disclaimer that its not your problem and you shouldn’t be accounted for this, will that make you a legal businessman? Never encourage these kind of websites and suggest them always to stop what they have been doing or else they would have to face these kind of consequences.

is that legal ? who are you to decide wht’s legal and not ? i’m a good singer, Sonu Nigam would never let me in, so why shouldn’t his songs be stolen ?

Sony Nigam is not going to stop you nor anyone in the world can stop ay talented person, so stop cursing someone just because they are famous now. If you have the guts and real talent to prove you need to show case it to the world and it would be recognized. The Engineering student did something which is similar to cheating, where in he acquired something for free and distributed for free in return earning money but the source is not going to allow this.

That matter is now closed so i don’t mind discussing here. I was in 11th standard when i received a legal notice from T Series which demanded removal of all MP3 links and Rs. 1 Crore as their losses resulting from it. I removed the songs and explained my case to them, that I am still a school going student and i didn’t really have any knowledge about copyrights and stuff and they never sent me any other notice or warning about the money.
It is true that many students still don’t know that giving links to mp3 files is illegal because many big sites like songs.pk etc are distributing it easily and millions of Indians are downloading freely so they would have understood my case.

Actually, before i removed the mp3 songs my site just starting receiving 15000 visitors a day and i was making Rs. 50000 p/m but now slowly the rankings are gone and so are earnings.
Now instead of giving links to mp3 and other copyrighted material i have a full time writer who writes movie review and music reviews and latest news from Bollywood.

    Amit,

songs.pk can be easily banned in India likewise google’s selective product are banned by chinese government. you need two licenses for legal streaming of Music, PPL (body of IMI) + IPRS. T-series content is not offered by this body but exclusively offered by hungama.con. Neeraj Roy and Bhushan Kumar of T-series have some arrangements. The earlier illegal websites sustained which now have become partly legal. Raaga.com – CEO Senthil, US , Smashits.com, CEO, Abesh Verma, US are still illegally or legally streaming songs remain doubt-able. Musicindiaonline.com, CEO, Anand Iyyer is a illegal site. All these sites draw a monthly traffic of 2-3 Million users and all these sites were launched in the year 1997-1999.
I have a hunch of following….when record labels like saregama, T-series or even ppl bodies see that there is a big traffic, they track down the owner who is mostly in US….they warn them to close the website or have a different arrangement of revenue sharing. Phulki folks, were threated by T-series which then were referred to smashits.com to jointly lanuch a new venture – saavn.com …but this is all black money….and it seems there are even corrupt people in the legal bodies of India who get monthly bribe from these illegal portals…Zero transparency but T-series may be enjoying black money ????

100 Main se 99 Baimaan, phir bhi mera bharat desh mahaan.

T-Series par ab koi aur kaam nahin, sirf notice bhejna reh gaya hai. Isko shayad pata nahin ki aaj kal movies songs hit hone par hi hit hoti hai. For example MUNNI BADNAAM, SHEEL KI JAWAANI like that. Kitne log india main 6-7 songs ke liye 250 INR kharch karenge ? To ye log pirated songs download karte hain and is tarah se songs hit ho jate hain kyunki jayda se jyda log gaane sun paate hain. and Saath main movie bhi hit ho jaati hai.

So in this case PIRACY is good.

And how many peoples this time didn’t break Indian copyright laws ?

If you are driving your car you will not insert original CD which contains only 6 songs and 100 % you don’t want to listen all songs. So if you are listing mp3 CDs of about 150 songs , you are breaking copyright laws.

Guyz we know our Crime branch department is fully corrupted. They will always take money from big piraters. And actually no 1 can stop piracy. If you share 1 song with your friend via Bluetooth is also piracy. So we cant blame anyone and spread it world wide that engineering student with “Display name” why to just point to one student. No one of us….is using original. We buy mp3 disc or download free from google. So we cant blame this innocent guy. Inshort we all are piraters..if piracy is so what called. And no 1 can stop piracy. Inshort there should not be any term Piracy. Media is always to share not to sell….the more we share more hit songs get…thats why people know actors and filmstars…if people dont hear songs then who will know who is the singer or who is the actor ? how it will get famous ? So Dear Amit, I think your should remove his name(nothing personal) but we dont have right to blame anyone and speard his/her name worldwide. Infact none of us use original songs. We all know that. We all download from google or take from bluetooth from friends.so we should really look @ this point.

I think this whole piracy issue has been around from the last decade or so, n also the technical knowledge of people now a days is quite low ,i mean many people around the world still dont know that softwares are copyrighted items n generally cost you a certain amount of money other than freewares ofcourse, but people take them for granted n i think this is the case here with these illegal sites users, n ofcourse more piracy has been due to the fact that there is a tie-up between the company n these site owners. So i think if the IT education doesnt get the importance in the education system the condition will only get worse…so by educating and promoting people piracy can be reduced although i doubt the facr that it can be completely stopped…

I have seen many websites in Internets, they are providing download links from songs.pk. From those website when I clicked on it the songs are downloading from songs.pk. So if any site indexed the download links from songs.pk or any other website who allow downloads and display it into their website, so user clicks on the link and the songs will download from the source site from they indexed. Is that legal or illegal ?

Also if site allow to only play songs from different source site like songs.pk instead of download. Is that legal ?

If any one knows the actual cyber related laws then please answers so those site owner who make the website same as the pattern I mentioned here can remove the links and protect the copyright laws.
